Definition Of Section 23 BNS Act-

Act of a person incapable of judgment by reason of intoxication caused against his willNothing is an offence which is done by a person who, at the time of doing it, is, by reason of intoxication, incapable of knowing the nature of the act, or that he is doing what is either wrong, or contrary to law;
provided that the thing which intoxicated him was administered to him without his knowledge or against his will.

Explanation Of Section 23 BNS :-

This Act is talking about situations where a person does something wrong (an offense) but was so intoxicated (drunk or under the influence of drugs) that they didn’t understand what they were doing, or didn’t realize it was wrong or illegal.

In such cases, the law says that the person cannot be held responsible for their actions if the intoxication happened without their consent—meaning someone else forced or tricked them into becoming intoxicated.

Conclusion:-

The law recognizes that people shouldn’t be held accountable for actions they take when they’re not in control of their judgment, but only if they were forced or tricked into that state.

If someone willingly gets intoxicated and then commits a crime, this rule doesn’t apply, and they can still be held responsible.
